Australia's Student Visa and Provider Transfer Changes: what education agents need to know (from 2 October 2026)
Several changes start together on 2 October 2026, and I'm already seeing them blurred into one "new rule". They are separate rules with different sources and dates. Here is how I keep them apart when training agents.
1. Provider transfer (National Code)
From 2 October 2026 to 30 June 2027, a receiving provider generally must not knowingly enrol an overseas student transferring from another registered provider. The exception is where the student has completed at least 12 months of their principal course with the releasing provider. This is subject to Standard 7.1A. From 1 July 2027 the period goes back to six months.
Three points agents often miss:
It is the principal course that counts, not the student's first day in Australia.
A student who commenced the principal course more than 6 but less than 12 months before commencement can become restricted again until 12 months are completed.
Standard 7.1A exceptions still exist: release by the releasing provider, ceased registration, an ESOS sanction, or a government sponsor's written support. Transfers from approved school providers are not changed by this amendment.
2. Student visa applications (subclass 500 / 590)
Most temporary visa holders in Australia will no longer be able to lodge a Student or Student Guardian visa application onshore. This includes people who hold a Student visa as a dependant and want to apply as the primary applicant. Where no exemption applies, the person must be outside Australia when lodging and when the visa is granted. Exemptions still exist, so "nobody can apply onshore" is wrong. The changes do not affect a current Student visa, and current Student Guardian visa holders can continue to lodge a further Student Guardian application in Australia.
3. Family
At application, family members generally can't be included unless an exemption applies. The factsheet lists PhD study, DFAT or Defence sponsorship, a foreign government scholarship, and eligible students from a Pacific or ASEAN member country.
After grant, current Student visa holders can no longer add family members as subsequent entrants. There are no exemptions to this rule.
If family are already included on a current Student visa and the student applies in Australia, they may be able to be included in the next application. Everyone included must be in the same location at lodgement.
So "go first, bring the family later" should not be promised.
4. Applications lodged before 2 October 2026
These continue to be assessed under the rules in place when they were lodged.
5. Mid-2027: separate and intended
The Explanatory Statement describes a separate migration reform, announced on 17 September 2026. It is intended to require a new Student visa before transferring to another international education provider, and it is intended to take effect in mid-2027. It is not part of the 2 October changes.
My practical rule for counsellors: check first, advise second, refer when necessary. Capture visa status, location, principal course, commencement date, months completed and family status before saying "yes" or "no". Update any script that says "transfer after six months" or "bring your family later."
This is general information for agent training. It is not legal or migration advice. Complex cases should go to an appropriately qualified migration professional.
